4. Nomination Process

All nomination content must:

Prizes are subject to availability and may be modified or substituted at our discretion. Winners are responsible for any taxes associated with prizes. No cash equivalent will be provided for non-monetary prizes.

7. Intellectual Property Rights

By submitting a nomination, you grant White Boy Magazine a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and create derivative works of your submission (including text, photographs, and other materials) in connection with the contest, magazine publication, marketing, and promotional activities.

7.2 Ownership

You represent and warrant that you own or have the necessary rights to grant the license described above, and that your submission does not infringe upon the rights of any third party.

7.3 Website Content

All content on the White Boy of the Year website, including text, graphics, logos, and software, is the property of White Boy Magazine or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8. Prohibited Conduct

You agree not to:

• Submit false, fraudulent, or misleading information
• Submit nominations without the nominee's consent
• Use automated systems, bots, or scripts to submit nominations or votes
• Engage in vote manipulation, vote buying, or other fraudulent voting practices
• Harass, threaten, or harm other participants or nominees
• Violate any applicable laws or regulations
• Interfere with or disrupt the contest or website operations
• Attempt to gain unauthorized access to our systems or data
• Impersonate any person or entity
• Submit content that violates third-party rights

9. Disqualification

We reserve the right to disqualify any nomination, nominee, or participant at any time if we determine, in our sole discretion, that:

• The participant engaged in fraudulent, deceptive, or prohibited conduct

Disqualified participants are not eligible for prizes and may be banned from future participation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHITE BOY MAGAZINE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES OR PARTICIPATION IN THE CONTEST.

11. Indemnification

You agree to indemnify, defend, and hold harmless White Boy Magazine and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of our services or participation in the contest
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit, including nominations

12. Disclaimers

OUR SERVICES AND THE CONTEST ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
